These Terms of Service constitute a legally binding agreement made between you, whether personally or on behalf of an entity (“you”) and Balay (“we”, “us”, or “our”), concerning your access to and use of our website and villa presentation services. By accessing the site, you acknowledge having read, understood, and agreed to be bound by all of these terms.
2. Architectural & Property Information
All villa renderings, architectural floor plans, dimensions, materials, and completion timelines presented on this website are for illustrative and conceptual purposes. While we strive for complete accuracy, final specifications and construction details will be formalized in the binding Sale and Purchase Agreement (PPJB) or Deed of Leasehold (Akta Sewa Menyewa).
3. Foreign Land & Title Rights
Property acquisitions by foreign nationals in the Republic of Indonesia are subject to agrarian laws (Undang-Undang Pokok Agraria) and relevant investment regulations. We assist buyers in obtaining compliant leasehold (Hak Sewa) or foreign investment company (PT PMA Hak Pakai / Hak Guna Bangunan) titles in coordination with licensed public notaries (PPAT).
4. Intellectual Property
Unless otherwise indicated, this website, its source code, databases, functionality, software, website designs, audio, video, text, photographs, and graphics on the site are our proprietary property and are protected by copyright, trademark, and unfair competition laws.
5. Governing Law & Jurisdiction
These Terms and your use of the website shall be governed by and construed in accordance with the laws of the Republic of Indonesia, without regard to its conflict of law principles.
